Jury Selection
People eligible to serve as jury members
In November of each year, each Connétable has to forward to the Viscount a list of the names and addresses of inhabitants of his/her parish who are capable of serving as jurors, being at least 25 years old and below the age of 65, not including those who are exempt by Law (see below).
Exemptions from jury service
Exemptions from jury service are contained in the Loi (1864) réglant la procédure criminelle.
People disqualified from serving on a jury
Article 10 of the Loi (1864) réglant la procédure criminelle specifies those who are disqualified from serving on a jury, e.g. persons under curatorship (because they are unable to manage their property and affairs) and people who within the previous 10 years have been convicted of an offence and have been:
(a) sentenced to prison or youth detention
(b) fined at level two or above on the standard scale
(c) placed on probation or condemned to similar punishment outside the Island
People are also disqualified from jury service if they are subject to a binding-over order which remains in force and those people who have been charged with any offence within or outside the island or for whom an arrest warrant has been issued.
Jury Selection
A panel of 45 potential jurors is selected randomly by computer programme (tirage). This process is supervised by two Jurats of the Royal Court. Prospective jurors are then summonsed to appear before the assize by the Viscount’s Department.
