			<content:encoded><![CDATA[<p>On 4 June 2010 the Judicial Committee of the Privy Council granted the appellants permission (or leave) to appeal the decision of the Court of Appeal of 12 August 2008. </p>
<p>The Court of Appeal decision of 12th August refused the appellants&#8217; applications for permission (or leave) to appeal the decision of Commissioner Sir Richard Tucker refusing to stay proceedings as an abuse of process or to rule inadmissible certain evidence. </p>
<p>The appeal before the Judicial Committee is estimated to last for two days is scheduled to take place in February/March 2011.</p>

			<content:encoded><![CDATA[<p>The appeals in the case of Attorney General &#8211; v &#8211; Claude James <strong>Donnelly </strong>and Attorney General &#8211; v &#8211; Gordon Claude <strong>Wateridge </strong>will commence at 10.30am on Tuesday 19 January 2010 at the Court of Appeal, St Helier, Jersey.</p>
<p>After two trials Mr Donnelly was convicted on 18 June 2009 of five counts of rape, 13 counts of indecent assault and one count of procuring an act of gross indecency. He was sentenced to 15 years imprisonment on 21 August 2009.</p>
<p>Mr Wateridge was convicted on 20 August 2009 of 11 counts of indecent assault and one count of common assault. He was sentenced on 21 September 2009 to two years imprisonment.  </p>
<p>The two appellants will be represented by Advocate Michael Preston. The prosecution will be represented by Crown Advocate Stephen Baker.</p>
