On 4 June 2010 the Judicial Committee of the Privy Council granted the appellants permission (or leave) to appeal the decision of the Court of Appeal of 12 August 2008.

The Court of Appeal decision of 12th August refused the appellants’ applications for permission (or leave) to appeal the decision of Commissioner Sir Richard Tucker refusing to stay proceedings as an abuse of process or to rule inadmissible certain evidence.

The appeal before the Judicial Committee is estimated to last for two days is scheduled to take place in February/March 2011.
